Subject: 19266/Letter Ruling from DOL Date: Fri, 2 Aug 1991 11:46:00 -0500 RESOLUTION NO. 19266 A RESOLUTION AUTHORIZING AND DIRECTING THE OFFICE OF THE CITY ATTORNEY TO REQUEST A LETTER RULING FROM THE UNITED STATES DEPARTMENT OF LABOR REQUESTING CLARIFICA- TION OF REGULATIONS GOVERNING OVERTIME WAGES TO BE PAID TO EMERGENCY MEDICAL SERVICE EMPLOYEES AND AUTHORIZING THE MAYOR TO EXECUTE A WAIVER OF THE STATUTE OF LIMITATIONS FOR CERTAIN CLAIMS UNDER THE FAIR LABOR STANDARDS ACT OF 1938, AS AMENDED, PENDING THE ISSUANCE OF THE LETTER RULING BY THE UNITED STATES DEPARTMENT OF LABOR. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That the Office of the City Attorney be and is hereby authorized and directed to request a letter ruling from the United States Department of Labor requesting clarification of regulations governing overtime wages to be paid to emergency medical service employees of the Department of Safety. BE IT FURTHER RESOLVED, that the Mayor be and is hereby authorized to execute a waiver of the statute of limitations under the Fair Labor Standards Act of 1938, as amended, for emergency medical service employees in the Department of Safety pending the issuance of the letter ruling by the United States Department of Labor concerning overtime wages to be paid to said employees, said waiver to be in a form to be approved by the Office of the City Attorney.
